Terms & Conditions – AffilCont.eu

1. Introduction

These Terms & Conditions govern the use of the affiliate platform operated by SmartCont s.r.o., located at Chudenická 30, 100 00 Prague – Hostivař, Czech Republic („AffilCont“, „we“, „us“). By registering and using the AffilCont.eu platform (the „Platform“), you agree to abide by these Terms, whether you are a publisher („Publisher“) or an advertiser („Advertiser“).

2. Registration and User Accounts

  • Users must provide accurate and up-to-date information during registration.
  • We reserve the right to approve or reject any account at our sole discretion.
  • Users are responsible for maintaining the confidentiality of their login credentials.
  • We reserve the right to suspend or terminate accounts for violations of these Terms.

3. Publishers – Promotion Rules

  • Publishers may only promote campaigns through approved channels (websites, email, social media, etc.) that comply with applicable laws and AffilCont’s content policies.
  • The use of misleading practices, spam, unauthorized SEM (e.g., brand bidding), incentivized traffic, or cookie stuffing is strictly prohibited.
  • Each campaign may have specific restrictions (e.g., coupon, cashback, or SEM rules) that the Publisher must follow.
  • Publishers must not alter any tracking links or promo materials provided by AffilCont.

4. Advertisers – Campaign Requirements

  • Advertisers must provide accurate and functional campaign materials, tracking setup (e.g., Postback, S2S, or Pixel), and commission terms.
  • Campaigns will be manually reviewed and approved by AffilCont before going live.
  • Advertisers must clearly define approval windows, payout conditions, and cookie durations.
  • AffilCont reserves the right to suspend or remove any campaign without notice if found non-compliant.

5. Commission Tracking and Payouts

  • All conversions are tracked using AffilCont’s tracking system.
  • Commissions are subject to approval by Advertisers and can be marked as approved, pending, or rejected.
  • The minimum payout is 50 €, and payouts are processed via bank transfer once per month.
  • Any disputes regarding commission validity must be raised within 30 days.

6. Prohibited Activities

Users may not:

  • Engage in fraudulent or deceptive activity.
  • Use malware, forced redirects, or manipulate tracking.
  • Promote illegal content or violate intellectual property rights.
  • Circumvent the tracking or payout process.

7. Data Protection and Privacy (GDPR)

  • SmartCont s.r.o. processes personal data in accordance with applicable data protection laws, including GDPR.
  • Personal data is collected for the purpose of managing user accounts, campaign performance, and payouts.
  • Users have the right to access, rectify, or delete their personal data upon request.

8. Termination

  • Users may terminate their account at any time by contacting AffilCont support.
  • AffilCont reserves the right to suspend or terminate any user for violations of these Terms.
  • Upon termination, unpaid commissions under the payout threshold may be forfeited.

9. Limitation of Liability

  • AffilCont is not liable for any loss of revenue due to platform downtime, technical errors, or inaccurate tracking beyond our control.
  • We do not guarantee continuous access to the platform or specific campaign performance.

10. Changes to Terms

Users will be notified of significant changes via email or platform notification.

AffilCont reserves the right to update or modify these Terms at any time.
